What
is GDPR?

The General Data Protection Regulation (GDPR) is new legislation coming into effect on May 25th, 2018. It standardizes data protection law across all EU countries and enforces new strict rules on controlling and processing personally identifiable information. It also extends the protection of personal data and data protection rights by giving control firmly back to EU residents.

There are multiple important items in the regulation, including increased fines, breach notifications, opt-in consent and responsibility for data transfer outside the EU. As a result, the impact to businesses here in Ireland is huge and will permanently change the way companies collect, store and use customer data.

GDPR applies to all organizations holding and processing EU resident’s personal data, regardless of geographic location. All companies in Ireland, of all sizes, are directly affected and need to put necessary measures in place to comply with the new GDPR legislation.


How will it really affect my company?

From a theoretical maximum of €500,000 that the Data Commissioner could levy under present legislation, fines under the new GDPR legislation will reach an upper limit of €20 million or 4% of the company’s annual global turnover – whichever is higher. This will have a significant impact on Irish companies found to be non-compliant or subject of a data breach.

Ireland’s Data protection commissioner, Helen Dixon stated “The GDPR is specifically structured to place responsibility on organisations” at Dublin Data Sec 2018. "Organisations now need to know that there will be a way of holding them to account if they do not shoulder responsibility………… sooner or later failure to demonstrate and implement accountability will catch-up with your organisation in some form or another". She continued “No organisation can afford to take the risk of not implementing” and while essential to put in place the various parts of the law, "these will all amount to nothing if your front-line staff do not understand the GDPR and if you fail to mitigate against the risks".


Are you ready?

Less than half of Irish businesses are ready for the new European General Data Protection Regulation (Irish Independent) and 35% admitted to not having staff training in place in relation to data security. With Article 39 of the GDPR specifically calling out that staff “awareness raising” and “training” are required, now is the time to address any remaining gaps in your company.
